Form No.02/PLI is a form that companies need when they want to submit an explanation of changes in foreign worker needs in Vietnam. How to fill out each part of the explanation of changes in foreign worker needs correctly

Here’s a simple guide to filling out each part of Form No.02/PLI issued with Decree No.70/2023/ND-CP:

• (1), (6) – Write the name of the government office where you’ll send your form. This is usually either:
  • The Ministry of Interior Affairs, or
  • The Department of Interior Affairs in your province or city

• (2) – List all job positions that the government has already approved for foreign workers. Use the same job titles that were in your first approval.

• (3) – Choose the type of work arrangement from this list:
  • Choose how your foreign employee will work. Pick from these options:
  • Regular employment contract
  • Transfer from your company’s office in another country
  • Working on a special contract (business, finance, healthcare, education, etc.)
  • Service provider
  • Service seller
  • Working for an international organization in Vietnam
  • Volunteer
  • Opening a new business office
  • Manager, director, expert, or technical worker
  • Working on a project in Vietnam
  • Family member of a diplomat allowed to work in Vietnam
• (4) – List details about your foreign workers:
  • How many foreign workers you need
  • What jobs they will do
  • Information about their work permits
  • How long they will work for you

• (5) – Explain how you tried to hire Vietnamese workers for these jobs. Since January 2024, you must tell how you:
  • Show that you posted the jobs on government websites
  • Explain your hiring process
  • Tell why you couldn’t find Vietnamese workers for these positions

You need to fill out Form No.02/PLI when you want to make these changes to your foreign workforce:

• The job position
• The job title
• How the person will work
• How many foreign workers you need
• Where the person will work
