How to fill in each part of the foreign worker Form No.01/PLI

The explanation form for foreign labor needs comes from Decree 70/2023/ND-CP. Here’s how to fill it out:

• (1), (5) Write the name of the government office that will receive your form – either the Ministry of Internal Affairs or your local Provincial Department.
• (2) Choose the type of work the foreigner will do:
  • Working with an employment contract
  • Transferred from the overseas office of the same company
  • Working under a business contract
  • Providing services
  • Volunteering
  • Managing a business
  • Working on a project

• (3) Write down:
  • How many foreign workers you need
  • What jobs they will do
  • If they need work permits or are exempt
  • How long they will work
• (4) Explain how you tried to find Vietnamese workers for these jobs first. Since January 2024, you must show that you posted the job on the government job website. Include information about:
  • Where you advertised the job
  • How many Vietnamese people applied
  • Why these Vietnamese applicants weren’t suitable

5 tips for filling foreign worker explanation form correctly

• This form is not for contractors hiring foreign workers.
• Use the correct version of Form No.01/PLI from Decree 70/2023/ND-CP.
• Include all company information in order: business type, number of employees, address, contact details, business license information, and who is submitting the form.
• Fill in all information about the foreign worker: job position, job title, number of workers needed, how long they’ll work, type of work, and workplace location.
• When explaining your need for foreign workers, include: current foreign workers (if any), detailed job description, education requirements, experience requirements, other skills needed, and clear reasons why a Vietnamese person can’t do this job.

9 reasons why Form No.01/PLI gets rejected and how to fix

• Job doesn’t match your business: Make sure the foreign worker’s job fits with what your company does.
• Too many foreign workers: The number should make sense for your company size.
• Education details are unclear: Clearly state what level of education, which field, and how many years of study are required.
• Weak explanation: Your reasons for needing a foreign worker must be convincing.
• Poor explanation why Vietnamese workers can’t do the job: Be specific about why local talent isn’t suitable.
• Wrong form: Make sure you’re using the current version of Form No.01/PLI.
• Unclear abbreviations: Don’t use short forms without explaining them.
• Missing permission letter: Include authorization documents when someone other than the company owner signs the form.
• Old business registration: Always use your latest business registration certificate.
